Do i calculate my Zakat on an Inheritance share ive yet to receive?


I am yet to receive some money for my share of inheritance from when my mother passed away. I don’t know when I will get it as there is some legal things that need to be taken care of before anything can be distributed but surely, I will receive a share. My question is that if I am calculating my zakat now, do I have to pay zakat on it now or once I get it?


In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In principle, inheritance that has not come into one’s possession is considered to be a weak debt. The ruling of weak debts is that Zakat is only due on the amount once one receives it and one is not required to pay Zakat on the amount for the period that one did not have possession of it.[1]

Accordingly, Zakat on the inheritance money owed to you will only be due once it has come into your possession.

واما الضعيف فهو مال غير بدل عن مال مثل مهر المرأة والصلح من دم العمد والسعاية والميراث والوصية ونحوها فهذا ليس عليه زكاة ما مضى فاذا خرج منه ما يكون نصابا ثم حال عليه الحول فعليه الزكاة وهي سواء كلها عند ابي حنيفة ومحمد فإذا خرج منه شيء فانه يزكي لما مضى بعد ان يكون الدين نصابا كاملا وحال عليه الحول

وأما الدين الضعيف فهو الذي وجب له بدلا عن شيء سواء وجب له بغير صنعه كالميراث، أو بصنعه كما لوصية، أو وجب بدلا عما ليس بمال كالمهر، وبدل الخلع، والصلح عن القصاص، وبدل الكتابة ولا زكاة فيه ما لم يقبض كله ويحول عليه الحول بعد القبض

وَفِي الدَّيْنِ الضَّعِيفِ لَا تَلْزَمُهُ الزَّكَاةُ مَا لَمْ يَقْبِضْ وَيَحُولُ الْحَوْلُ عِنْدَهُ


تحفة الفقهاء (1/ 294)

وأما الدين الضعيف فهو ما وجب وملك لا بدلا عن شيء وهو دين إما بغير فعله كالميراث أو بفعله كالوصية أو وجب بدلا عما ليس بمال دينا كالدية على العاقلة والمهر وبدل الخلع والصلح عن دم العمد وبدل الكناية
