Clarification on Fatwa of tenders


As salamu alaikum, Jazak Allah mufti sb for your reply (Fatwaa #45480 on 24th September). After going through it, I feel I haven’t given all the details properly. Firstly, I would like to mention that in my position as Engineering manager, I was not responsible for sales or pricing tenders (but only responsible for design and implementation work). but due to some people leaving I have been made to handle this additional responsibility since quite some time now. however, for my question we will assume it to my duty.

As I mentioned earlier, I am planning to do some business with a friend of mine by working outside office hours (my friend doesn’t work in the company I work). For our business, we found a unique antenna which provides higher 4G/5G speeds that is made in the USA and we imported it over here and presented it to our customer. our customer requested a trial unit which we provided and they were pleased with its performance and we even gave them an approximate budgetary quotation for this product. As per the client policy any purchase must be done through tendering. It is now that a tender will be floated and multiple companies will participate and surely the company where I work will also participate. So, till now, I have not derived any benefit for the company I work in terms of pricing but rather put in all the efforts and money for sample unit by myself.


So, I have two questions and would be grateful if you could answer both of them separately:

1. Given the scenario above wherein I have done all the initial work at my own cost and not derived any benefit from the company where I work; will it still be impermissible for me to carry out this transaction outside office hours [unless I either notify the company I work for, or I ask to be excused of the pricing duty]?

2. What if I ask my partner to do the pricing and he keeps the final pricing from me confidential. This way, I will not know what is the final price he has offered after discounts?


I would really like to do the pricing myself as my partner is not an expert when it comes to financials but if no option remains, then I look forward to your advice on this.

At the outset, we apologise for the belated response.

According to your explanation, the antenna business you refer to belongs to you and your friend. It does not belong to the company you are working for. Your employment company may bid to tender the item due to the client requirement of tendering.

Based on our understanding of the information provided, it is permissible for you to start up your own business as long as it does not become an impediment in your current duties.[1]

We advise you to inform your employment company that you are the owner of the antenna business and you wish to be excluded from pricing the tender on behalf of the company due to conflict of interest.

If this is not plausible, then you should adopt the proposed solution of making your partner in charge of the pricing without informing you of the final price.

وليس للظئر أن تأخذ صبيا آخر فترضعه مع الأول، فإن أخذت صبيا آخر فأرضعته مع الأول فقد أساءت وأثمت إن كانت قد أضرت بالصبي، ولها الأجر على الأول والآخر، (أما) الإثم فلأنه قد استحق عليها كمال الرضاع، ولما أرضعت صبيين فقد أضرت بأحدهما لنقصان اللبن،….وأما ما كان فيه وهم الضرر فليس لهم منعها عنه

(والأجير الخاص) - ويسمى أجير واحدٍ أيضا - هو (الذي) يعمل لواحد عملا موقتا بالتخصيص، ومن أحكامه أنه (يستحق الأجرة بتسليم نفسه في المدة) المعقود عليها (وإن لم يعمل) وذلك (كمن استؤجر شهراً للخدمة أو لرعي الغنم) ؛ لأن المعقود عليه تسليم نفسه، لا عمله، كالدار المستأجرة للسكنى، والأجر مقابل بها، فيستحقه ما لم يمنع من العمل مانع كمرض ومطر ونحوهما مما يمنع التمكن من العمل. ثم الأجير للخدمة أو لرعي الغنم إنما يكون خاصا إذا شرط عليه أن لا يخدم غيره ولا يرعى لغيره أو ذكر المدة أو لا، كأن يستأجره شهراً ليرعى له غنما مسماة بأجر معلوم فإنه أجير خاص بأول الكلام، وتمامه في الدرر، ولبس للخاص أن يعمل لغيره، ولو عمل نقص من أجرته بقدر ما عمل، فتاوى النوازل (ولا ضمان على الأجير الخاص فيما تلف في يده) بأن سرق منه أو غصب لأنه أمانة في يده،
