Earning commission unlawfully - Is this permissible?


Assalamu alaykum

One person is an agent for a company to sell their goods  and services and he receives commission for selling those goods. Now if the agent himself buys the goods from the company on the same price, is it permissible for him to get the comission for such a transaction? For some companies the transactions are computed electronically like mobile companies. In this case the company does not know who the buyer is.The agent does the transaction on their behalf ,be it for other customers or himself and the commission is credited to his account.In this scenario is it permissible for the agent to take the commission when he himself is the buyer?

If it is not permissible and the agent is not able to separate his personal transactions from those of the customers what will he do with the accumulated commissions?

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In principle, if one is an agent to sell goods, the agent himself cannot purchase the goods as that will lead one to be a seller and a purchaser in one transaction. [1]

The agent may inform the company that he has purchased the goods for himself and if they approve of the agency commission, that will be regarded as a discount in his favour.

For example, the goods the agent is purchasing for himself is worth R1000. The agency commission for such a sale is R100. Therefore, the company will now sell him the goods for R900. The commission he was supposed to have received has now become a discount.

However, if the company does not agree for him to purchase the goods, then the commission earned from such purchases will not be permissible. This commission must be returned to the company or dispensed off to the poor and needy.[2]
