Is spear fishing permissible?

Is spear fishing allowed?

Answer

Wa Alaykumus Salaam Wa Rahmatullahi Wa Barakaatuh

In the Name of Allah, the Most Gracious, the Most Merciful.

Respected Sister in Islam ,

Spear-fishing is  permissible (Mubah) just like normal fishing [1] .

The principle of a Mubah act is, it should not impede in fulfilling ones Shari obligations , for example Salaah etc [2].

1]   المبسوط للسرخسي (11/ 245)

فَإِنَّ الْحِلَّ فِي هَذِهِ الْأَشْيَاءِ لَيْسَ يَثْبُتُ بِالْفِعْلِ حَتَّى يَحِلَّ، وَإِنْ مَاتَ بِغَيْرِ فِعْلِ أَحَدٍ وَلَا اقْتِرَابِ التَّسْمِيَةِ بِالْفِعْلِ، فَلَا يُشْتَرَطُ التَّسْمِيَةُ لِلْحِلِّ فِيمَا لَا يُشْتَرَطُ فِيهِ الْفِعْلُ

 

أُحِلَّ لَكُمْ صَيْدُ الْبَحْرِ وَطَعَامُهُ مَتَاعًا لَّكُمْ وَلِلسَّيَّارَةِ ۖ

تحفة الفقهاء (3/ 64)

وَكَذَلِكَ اصطياد مَا فِي الْبَحْر حَلَال فِي حق الْمحرم والحلال

 

شرح تحفة الملوك( 1734/2)

ولو نصب شبكة فوقع فيها صيدا أو رمی شصًّا[حديدة معقوفة مخصصة لصيد السمک وهو بالفتح والكسر شيء يصادبه السمك[ فتعلقت به سمكة ، فاضطربا أی تحركا حتی انقطعت الشبكة ، وخيط الشص فخلصا أي وصل أحدهما إلى الآخر فصادهما آخر فهما له

وفي الخلاصة : الشص ( وهوحديدة عقفاء پصاد بھاالسمک) إذا رمی به الرجل في الماء ، فتعلق به السمک: إن رمی به خارج الماء في موضع يقدر على أخذه، فاضطرب قرقع في الماء ، ملکه ، فليس لرجل آخر أخذه بالاصطياد ، وإن انقطع الحبل قبل أن يخرجه من الماء ،لايملكه . ولو لدغت سمكة حية في الماء وقتلتها، أو أصابتها حديدة ، أو أكلت شيئا ألقاه في الماء ، أو قتالها شيء من طير الماء أو غيره ، تؤكل ، لأنها ماتت بسبب .

احْتَجُّوا بِظَاهِرِ قَوْلِهِ تَبَارَكَ وَتَعَالَى  ]أُحِلَّ لَكُمْ صَيْدُ الْبَحْرِ[المائدة: 96 وَاسْمُ الصَّيْدِ يَقَعُ عَلَى مَا سِوَى السَّمَكِ مِنْ حَيَوَانِ الْبَحْرِ فَيَقْتَضِي أَنْ يَكُونَ الْكُلُّ حَلَالًا  … لِأَنَّ الْمُرَادَ مِنْ الصَّيْدِ الْمَذْكُورِ هُوَ فِعْلُ الصَّيْدِ وَهُوَ الِاصْطِيَادُ؛ لِأَنَّهُ هُوَ الصَّيْدُ حَقِيقَةً لَا الْمِصْيَدُ؛ لِأَنَّهُ مَفْعُولُ فِعْلِ الصَّيْدِ

قَوْلُهُ فَكَانَ مَنْدُوبًا) إنَّمَا يَكُونُ كَذَلِكَ بِالْقَصْدِ؛ أَمَّا إذَا قَصَدَ التَّلَهِّيَ أَوْ الْفَخْرَ أَوْ لِتُرَى شُجَاعَتُهُ فَالظَّاهِرُ الْكَرَاهَةُ، لِأَنَّ الْأَعْمَالَ بِالنِّيَّاتِ فَكَمَا يَكُونُ الْمُبَاحُ طَاعَةً بِالنِّيَّةِ تَصِيرُ الطَّاعَةُ مَعْصِيَةً بِالنِّيَّةِ ط (قَوْلُهُ أَمَّا بِدُونِهِ) ظَاهِرُهُ أَنَّهُ مُرْتَبِطٌ بِكَلَامِ الْأَئِمَّةِ الثَّلَاثَةِ، وَمَا يَأْتِي يُفِيدُ أَنَّ هَذَا لِأَهْلِ الْمَذْهَبِ ط وَمِثْلُهُ مَا قَدَّمْنَاهُ آنِفًا عَنْ مَسَائِلَ شَتَّى (قَوْلُهُ فَيُبَاحُ كُلُّ الْمَلَاعِبِ) أَيْ الَّتِي تُعَلِّمُ الْفُرُوسِيَّةَ وَتُعِينُ عَلَى الْجِهَادِ، لِأَنَّ جَوَازَ الْجُعْلِ فِيمَا مَرَّ إنَّمَا ثَبَتَ بِالْحَدِيثِ عَلَى خِلَافِ الْقِيَاسِ، فَيَجُوزُ مَا عَدَاهَا بِدُونِ الْجُعْلِ. وَفِي الْقُهُسْتَانِيِّ عَنْ الْمُلْتَقِطِ مَنْ لَعِبَ بِالصَّوْلَجَانِ يُرِيدُ الْفُرُوسِيَّةَ يَجُوزُ وَعَنْ الْجَوَاهِرِ قَدْ جَاءَ الْأَثَرُ فِي رُخْصَةِ الْمُصَارَعَةِ لِتَحْصِيلِ الْقُدْرَةِ عَلَى الْمُقَاتَلَةِ دُونَ التَّلَهِّي فَإِنَّهُ مَكْرُوهٌ.
