Taking from the Zakaat money for a service rendered - Is this permissible?



For many years I use to rent a property and also give my own Zakat every year towards a number of project/causes overseen by my own Family, during this time I would also collect from Friends & others who would give me Zakat & Lillah, they would leave it to me to sort out where I felt best to utilise it. However a few years ago I moved out of the rented property due to some issues and borrowed money to purchase my own property so since then I have not been paying Zakat rather have I been entitled to Zakat yet any monies people give me who still leave it at my discretion I continue to spend on to the relevant projects/causes. As these projects require time & effort I have the following Qs:

1) How much can I take out for myself from the monies for my efforts e.g. 1/8?

2) As I myself am in a debt can I take any small amount for myself so that my debt can be eased?



In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

If people give you Zakaah to distribute to worthy and legitimate recipients of Zakaah, you cannot pay and reward yourself for your time and efforts from the Zakaah funds. You may request the Zakaah donors to contribute Lillah funds to you for your time and efforts.

If people have given you Zakah funds to distribute to worthy and legitimate recipients and causes of Zakah, you cannot use any portion of the Zakaah for yourself despite you being a legitimate recipient of Zakaah. The donors have made you their representative (Wakeel) to distribute to others and not to you.

If you are in need of Zakaah, you may explain your predicament to the donors and if they permit you to use the Zakaah for yourself, then only it will be permissible to use such Zakaah funds on yourself. [1]

وَلِلْوَكِيلِ بِدَفْعِ الزَّكَاةِ أَنْ يَدْفَعَهَا إلَى وَلَدِ نَفْسِهِ كَبِيرًا كان أو صَغِيرًا وَإِلَى امْرَأَتِهِ إذَا كَانُوا مَحَاوِيجَ وَلَا يَجُوزُ أَنْ يُمْسِكَ لِنَفْسِهِ شيأ اه

 إلَّا إذَا قال ضَعْهَا حَيْثُ شِئْتَ فَلَهُ أَنْ يُمْسِكَهَا لِنَفْسِهِ

 كَذَا في الْوَلْوَالِجيَّةِ

)قوله ولو تصدق إلخ ) أي الوكيل بدفع الزكاة إذا أمسك دراهم الموكل ودفع من ماله ليرجع ببدلها في دراهم الموكل صح .

بخلاف ما إذا أنفقها أولا على نفسه مثلا ثم دفع من ماله فهو متبرع
