Title

Is the woman in reference eligible for Zakat?

Question

Assalmualaikum, I hope this finds you in good health and high islamic spirits.

My question is in regards to Zakaah:

If a woman (widow) is in debt and has no other means of earning and relies on give aways from well wishers and family for her daily rations and upkeep. However  she does have Gold that she posses and has been passed onto her by her parents. The gold is above the nisab value . In that case is she eligible to receive zakaah?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

The Nisaab of gold is 87.48g. If after deducting the debts of the widow from the value of her assets (gold, cash etc.), her wealth falls below the Zakat Nisaab amount, then she will be eligible to accept Zakat.

However, if after deducting her debts from her assets, her wealth still remains above the Zakat Nisaab, then she will not be eligible to accept Zakat.[i]

البناية شرح الهداية (3/ 453)

والغارم من لزمه دين ولا يملك نصابا فاضلا عن دينه

(والغارم من لزمه دين ولا يملك نصابا فاضلا عن دينه) ش: هذا هو الخامس من المصارف يعني يصرف للغارم أيضا، قوله: من لزمه دين، إلى آخره تفسير الغارم، وهو من الغرم، وهو من الخسران، وكان الغارم هو الذي خسر ماله، والخسران النقصان.

وقال أبو نصر البغدادي: الغارم من لزمه دين وإن كان في يده مال، لأنه يستحق بالدين فصار كمن لا مال له،

…اور یہ بات بھی یاد رکھیں کہ حضرات فقہاء نے مقروض کو اپنا قرض اداکرنے کیلئے زکاۃ دینے کی جو گنجائش لکھی ہے اس سے مراد فقہاء کے زمانہ کا قرض ہے، اس زمانہ میں وہی شخص مقروض ہواکرتاتھا، جسکو اپنے گھر میں خود کھانے اور بال بچوں کے کھانے کے لئے نہیں ہوتاتھا، وہ اپنے اور بال بچوں کا پیٹ بھرنے کیلئے دوسروں سے قرض لیتا تھا، پھر
