Talaq Mugallazah - Permanent irrevocable divorce


If the husband said to other family members that i have gaven my wife 3 things from my heart.
Later on when an alim asks him what did you say. He said i already gave my wife 3 talaq.
What will be the hukum.
the wife has 3 kids its only been 4 years of marriage.


In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

If the husband issued his wife three Talaqs and he clarified that with the Alim who enquired from him on what he meant by giving three things from the heart, then that constitutes as Talaq Mugallazah (permanent irrevocable divorce). Accordingly, the husband’s Nikah with her is permanently terminated.[1]

(ولنا) ما روي عن عبادة بن الصامت - رضي الله عنه - أن بعض آبائه طلق امرأته ألفا فذكر ذلك للنبي - صلى الله عليه وسلم - فقال - صلى الله عليه وسلم - «بانت بالثلاث في معصية وتسعمائة وسبعة وتسعون فيما لا يملك». وروي عن ابن عباس - رضي الله عنهما - أنه قال إن أحدكم يركب الأحموقة فيطلق امرأته ألفا ثم يأتي فيقول: " يا ابن عباس يا ابن عباس وإن الله تعالى قال: {ومن يتق الله يجعل له مخرجا} [الطلاق: 2] وإنك لم تتق الله فلا أجد لك مخرجا بانت امرأتك وعصيت ربك وروينا عن عمر - رضي الله عنه - أنه كان لا يؤتى برجل قد طلق امرأته ثلاثا إلا أوجعه ضربا وأجاز ذلك عليه وكانت قضاياه بمحضر من الصحابة - رضي الله عنهم - أجمعين فيكون إجماعا منهم على ذلك.
