Income derived from a Brewery - Is it Halaal?


Assalamualeikum w.r.w.b.

Dear respected Mufti Sahib;

I have a question regarding whether the left over money from a Haraam job is Halaal for me or Haraam.

I worked in a brewery bevore i became muslim. There i was active in all branches, such as brewhouse, fermentation cellar, pressure tank cellar, filtration and bottling. This was a kind of schooling for me and i also did a lot of repairing and cleaning in the factory. 

After that i converted to Islam. When i converted to Islam i didnt know about Halaal and Haraam for a long time. And i even asked a Muslim Family about my work, but they said it is ok, as long as i dont drink alcohol. After a period of time, i found out about Halaal and Haraam money, it didnt take me 2-3 Months until i quitted the occupaton. 

Now the question is that: Is the remaining money from the occupation Halaal for me or not; because i earned it in Jaahiliyyah. 

I am currenty living on that money also. I have just recently started a new apprenticeship, where i am earning 600 to 700 Euro monthly (which isnt so much). In the brewry i used to earn 5000 Euro. 

Also: I am planing to go and study in a Madrasah; am i allowed to use that money to pay my fees for the Madrasah?

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Brother in Islam,

We are pleased to note that you have been guided on the right path. May the Almighty keep us all steadfast on Imaan. Aameen.

We observe you are conscious of staying away from Haraam. That stems from your consciousness of Imaan. Your attitude is praiseworthy.

The income derived before reverting to Islam will be Halaal for you.

Shari’ah has emphasized on earning halaal income.

Nabi (ﷺ) said:

طَلَبُ كَسْبِ الْحَلَالِ فَرِيضَةٌ بَعْدَ الْفَرِيضَةِ

Translation: Earning of Halal income is an obligation beyond other obligations.

(Shuabul Imaan, Baihaqi)

Unfortunately, you were misinformed by the Muslim family.

It is not permissible to work for a brewery company, as this would entail directly assisting in haram activities. [1] The income derived from such a business after reverting to Islam is not Halaal and should be disposed of in charity without the intention of reward.

Allah Taa’la says:

وَلَا تَعَاوَنُوا عَلَى الْإِثْمِ 

Translation: “And do not assist one another in sin”

(Surah Al-Maaidha, Aayah 2)

However, if you are financially constrained, you will be excused to utilise the income derived from such business.

We advise you to utilise pure halaal money to pay Madrasah fees. [2] If halaal and haram funds are combined, and the halaal funds outweigh the haram funds, such funds could be utilised for Madrasah fees. [3]

We make dua Allah opens His doors of sustenance for you and provide you with all your requirements in a halal manner.  Aameen.

ولو أن رجلاً أهدى إليه إنسان يكتسب من ربا أو رجل ظالم يأخذ أموال الناس أو اضافة فإن كان غالب ماله من حرام فلا ينبغي له أن يقبل ولا يأكل من طعامه ما لم يخبره أن ذلك المال أصله حلال ورثه أو استقرضه أو نحو ذلك. فإن كان غالب ماله حلال فلا بأس بأن يقبل هديته ويأكل منه ما لم يتبين عنده أنه من حرام

وَفِي الْبَزَّازِيَّةِ غَالِبُ مَالِ الْمُهْدِي إنْ حَلَالًا لَا بَأْسَ بِقَبُولِ هَدِيَّتِهِ وَأَكْلِ مَالِهِ مَا لَمْ يَتَبَيَّنْ أَنَّهُ مِنْ حَرَامٍ؛ لِأَنَّ أَمْوَالَ النَّاسِ لَا يَخْلُو عَنْ حَرَامٍ فَيُعْتَبَرُ الْغَالِبُ وَإِنْ غَالَبَ مَالَهُ الْحَرَامُ لَا يَقْبَلُهَا وَلَا يَأْكُلُ إلَّا إذَا قَالَ إنَّهُ حَلَالٌ أُورِثْتُهُ وَاسْتَقْرَضْتُهُ وَلِهَذَا قَالَ أَصْحَابُنَا لَوْ أَخَذَ مُورِثُهُ رِشْوَةً أَوْ ظُلْمًا إنْ عَلِمَ وَارِثُهُ ذَلِكَ بِعَيْنِهِ لَا يَحِلُّ لَهُ أَخْذُهُ وَإِنْ لَمْ يَعْلَمْهُ بِعَيْنِهِ لَهُ أَخَذَهُ حُكْمًا لَا دِيَانَةً فَيَتَصَدَّقُ بِهِ بِنِيَّةِ الْخُصَمَاءِ
