Is my father responsible for paying back this money?


Assalamualaikum Mufti Sahab, Couple of years ago my uncle who came back from Saudi gave somy to my father and asked him to exchange it, the exchanged amount was very huge. After exchanging the amount my father came back to our house and after couple of days he took the bag with the cash and boarded a Bus to hand it over to my uncle in my native place. Unfortunately someone robbed that bag from my father in the Bus and we lost the entire amount.

Since my father is retired and does not have any income, but we managed to return half of the amount in these years and our relatives also contributed some amount to help my father. My question is, since this was an unfortunate incident, is my uncle also responsible to share the loss because it was an accident and the amount is very big or do we have to return the entire amount to my uncle. Please give solution in the light of Hadith and Sharia Law.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In the enquired scenario, your father was appointed as an agent for exchanging the money. Hence, the money in your father’s hands was an amaanah (trust). As your father was not negligent as established above, he will not responsible for paying back the stolen money.

((ولا ضمان على الأجير الخاص فيما تلف في يده) بأن سرق منه أو غصب لأنه أمانة في يده، لأنه قبضه بإذنه (ولا ما تلف من عمله) العمل المعتاد: كتخريق للثوب من دقه، لأن منافعه صارت مملوكة للمستأجر، فإذا أمره بالصرف إلى ملكه صح وصار نائبا منابه فصار فعله منقولا إليه كأنه فعله بنفسه، قيدنا العمل بالمعتاد لأنه لو كان غير معتاد بأن تعمد الفساد ضمن كالمودع.

ولا ضمان على الأجير الخاص فيما تلف في يده ولا ما تلف من عمله" أما الأول فلأن العين أمانة في يده؛ لأنه قبض بإذنه، وهذا ظاهر عند أبي حنيفة، وكذا عندهما؛ لأن تضمين الأجير المشترك نوع استحسان عندهما لصيانة أموال الناس، والأجير الوحد لا يتقبل الأعمال فتكون السلامة غالبة فيؤخذ فيه القياس، وأما الثاني فلأن المنافع متى صارت مملوكة للمستأجر فإذا أمره بالتصرف في ملكه صح ويصير نائبا منابه فيصير فعله منقولا إليه كأنه فعل بنفسه فلهذا لا يضمنه، والله أعلم بالصواب
