Title

Missing 4 Rakaats Sunnah Before Jumuah - Can i read it after jumuah Salaah?

Question

Asalamualaikum Mufti saab,
I wanted to ask two questions please:
1. I work a full time job in the UK for a government organisation, and my
taxes are taken out automatically when i get paid.  Unfortunately the income
i get is not adequate for my family's needs, so i've taken on a second part
time job as a delivery driver which i do two days a week.  For this job the
employer gives me  cash in hand, do i need to declare this to the government
and get taxed again on this.  As i'm already paying tax on one employment i
didn't feel the need to report my second income.  Should i be doing this?

2. At Jumma prayers i sometime miss the four sunnat rakaats before the Fardh
salaat, do i need to make up for this after fardh or do i just read Four
sunnat and two sunnat rakaats after fardh.  I follow the Hanafi method of
praying.

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

1.     A citizen of a country must abide by the laws of the country on condition the laws of the country are not against Shariah

 

A Muslim must always maintain his honor and dignity and avoid doing anything that will disgrace him and embarrass him. Rasulullah (Sallallahu Alaihi Wasallam) said:

 

‏"‏ لاَ يَنْبَغِي لِلْمُؤْمِنِ أَنْ يُذِلَّ نَفْسَهُ ‏" (جامع الترمذي: 2554)

Translation: “It is not befitting for a believer to humiliate himself.” (Jami Al-Tirmidhi:2554)

We advise you to consult a tax lawyer and adopt a position in keeping with the above principles outlined by us.

 

2.     If one has missed the four Sunnah before the Jumu‘ah Salah, then he should perform them after the Jumu‘ah Salah.[i]

بدائع الصنائع في ترتيب الشرائع (1/ 285) [i]

أما السنة قبل الجمعة وبعدها فقد ذكر في الأصل: وأربع قبل الجمعة، وأربع بعدها، وكذا ذكر الكرخي، وذكر الطحاوي عن أبي يوسف أنه قال يصلي بعدها ستا وقيل: هو مذهب علي - رضي الله عنه - وما ذكرنا أنه كان يصلي أربعا مذهب ابن مسعود، وذكر محمد في كتاب الصوم أن المعتكف يمكث في المسجد الجامع مقدار ما يصلي أربع ركعات، أو ست ركعات أما الأربع قبل الجمعة؛ فلما روي عن ابن عمر - رضي الله عنه - «أن النبي - صلى الله عليه وسلم - كان يتطوع قبل الجمعة بأربع ركعات» ؛ ولأن الجمعة نظير الظهر، ثم التطوع قبل الظهر أربع ركعات كذا قبلها

110 -  سنَن الرَّوَاتِب وَهِي رَكْعَتَانِ قبل الْفجْر وَأَرْبع قبل الظّهْر وركعتان بعْدهَا وَأَرْبع قبل الْعَصْر أَو رَكْعَتَانِ وركعتان بعد الْمغرب وَأَرْبع قبل الْعشَاء وَبعدهَا أَربع أَو رَكْعَتَانِ وَأَرْبع قبل الْجُمُعَة وَأَرْبع بعْدهَا

 

فتاوی فریدیہ (ج:3 ص:120)

جمعہ سے قبل چار سنت رہ جائیں تو بعد میں پڑھنا احوط ہے

الجواب: یہ سنت قبلیہ جب فوت ہوں تو اس میں فقہا کے دو قول ہیں ، اقویٰ من حیث الدلیل سقوط ہے البتہ پڑھنا ممنوع نہیں ہے بلکہ احوط ہے {۱}۔ وھوالموفق

 

آپ کے مسائل اور ان کا حل (ج:4 ص:146)

ج… ظہر اور جمعہ سے پہلے چار رکعت سنت موٴکدہ ہیں، اگر پہلے پڑھنے کا موقع نہ ملے تو بعد میں پڑھنا ضروری ہے۔
