Phone text of three divorce words

Question

Assalam-o-aliakum Sheikh, my son divorced his wife send phone text of 3 divorce words, can her ex-wife make another Nikah without any certificate/paper from Sheikh ? If she has made another Nikah unknowingly after 3 months of this divorce will it be valid ? if not what she need to do to make it valid ?      

Answer

In the Name of Allah, the Most Gracious, the Most Merciful. 

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh. 

 

If the husband (your son) issued three divorce words (Talaaq) to his wife through phone text, that constitutes a Talaaq-e-Mughallazah which terminates the Nikaah completely. [1] The divorcee will have to spend Iddat of three menstrual cycles or till birth if she is pregnant.  [2]

 

She may marry someone else besides her ex-husband (your son) after her Iddat. She cannot marry her ex-husband.

 

We do not know what you mean by “she made another Nikaah unknowingly.’’  Nevertheless, a Nikaah takes place if there is an offer of marriage (Iejab) and acceptance (Qubool) in the presence of atleast two adult male Muslims.[3]  

 

If a Nikaah takes place without the Nikaah being recorded in a certificate, the Nikaah will be valid.

(قَالَ)، وَإِذَا طَلَّقَهَا طَلَاقًا بَائِنًا وَلَيْسَ لَهُ إلَّا بَيْتٌ وَاحِدٌ فَيَنْبَغِي أَنْ يَجْعَلَ بَيْنَهُ وَبَيْنَهَا سِتْرًا وَحِجَابًا لِأَنَّهُ مَمْنُوعٌ مِنْ الْخَلْوَةِ بِهَا بَعْدَ ارْتِفَاعِ النِّكَاحِ فَيَتَّخِذُ بَيْنَهُ وَبَيْنَهَا سُتْرَةً حَتَّى يَكُونَ فِي حُكْمِ بَيْتَيْنِ

 

الأصل المعروف بالمبسوط للشيباني (1/ 460)

 أَلا ترى أَن الله تبَارك وَتَعَالَى جعل على الَّتِي تحيض من الْعدة ثَلَاثَة قُرُوء فَإِن لم تكن تحيض من كبر أَو صغر جعل عَلَيْهَا ثَلَاثَة أشهر فَجعل مَكَان كل حَيْضَة شهر وَهَذَا الْغَالِب من أُمُور النِّسَاء

 

شرح مختصر الطحاوي للجصاص (5/ 235)

* وروي عن عمر بن الخطاب، وابن عباس: أنها تمكث تسعة أشهر، فإن لم تحض: اعتدت ثلاثة أشهر بعد ذلك.

 

الأصل للشيباني ط قطر (4/ 393)

والعدة هي الحيض كما قال الله تعالى في كتابه: {ثَلَاثَةَ قُرُوءٍ} (2). والقرء هو الحيض.

 

{وَالْمُطَلَّقَاتُ يَتَرَبَّصْنَ بِأَنْفُسِهِنَّ ثَلاثَةَ قُرُوءٍ} [البقرة: 228]

فإن قال قائل: الحمل محكوم عليه قبل الولادة. قال الله تعالى: {وأولات الأحمال أجلهن أن يضعن حملهن}، وقال: {فأنفقوا عليهن حتى يضعن حملهن}.

النكاح ينعقد بالإيجاب والقبول بلفظين يعبر بهما عن الماضي أو يعبر بأحدهما عن الماضي وبالآخر عن المستقبل مثل أن يقول: زوجتي فيقول زوجتك

ولا يعقد نكاح المسلمين إلا بحضور شاهدين حرين بالغين عاقلين مسلمين أو رجل

وامرأتين عدولا كانوا غيرا عدول أو محدودين في قذف
