Title

My husband gave me triple talaq by saying "I divorce you" three times in one sitting

Question

I have a question regarding triple talaq.

My husband gave me triple talaq by saying "I divorce you" three times in one sitting. His Islamic knowledge is limited therefore he did not realise this would amount to 3 talaqs. He says he doesn't follow any madhab therefore it is up to him what he makes of this talaq. I however, believe this to be an irrevocable divorce.

He is now asking me to give him a khul' as he doesn't believe we are properly divorced and says I am doing haram by living away from him.

Please advise me on what I should do.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Sister in Islam,

In principle, if your husband has issued you three talaqs in one sitting, then talaq-e-mugallazah (a permanently irrevocable divorce) takes place.[1] Accordingly, you are no longer husband and wife.[2]

In Shariah, khula is when the wife requests a divorce in exchange of mahr or monetary exchange.[3] However, in your instance, the nikah has already been terminated through the three divorces. It is not up to your ex-husband to decide what he makes of this divorce.

1.     Proof from the Quran:

فَإِن طَلَّقَهَا فَلاَ تَحِلُّ لَهُ مِن بَعْدُ حَتَّىَ تَنكِحَ زَوْجًا غَيْرَهُ فَإِن طَلَّقَهَا فَلاَ جُنَاحَ عَلَيْهِمَا أَن يَتَرَاجَعَا إِن ظَنَّا أَن يُقِيمَا حُدُودَ اللَّهِ وَتِلْكَ حُدُودُ اللَّهِ يُبَيِّنُهَا لِقَوْمٍ يَعْلَمُونَ (سورة البقرة- آيت230)  

“And if he has divorced her (the third time), then she is not lawful unto him until she has married another husband. Then, if the other husband divorces her, there will be no sin on both of them if they reunite, provided they feel that they can keep the limits ordained by Allah. These are the limits of Allah, which He makes plain for the people who have knowledge.” Surah Al-Baqarah verse 230

It is clear from the above verse, once the husband issued the third divorce, he can take her back only after halala, that is the divorcee marries another man after the expiry of iddah and the second marriage is consummated. If the second husband voluntarily divorces her, she may remarry her ex-husband after the expiry of the iddah of the second marriage.

2.     Proofs from the Hadith:

1)

عن عائشة: أن رجلا طلق امرأته ثلاثا فتزوجت فطلق فسئل النبي صلى الله عليه و سلم أتحل للأول ؟ قال (لا حتى يذوق عسيلتها كما ذاق الأول) - بخاري (ج5/ ص2014)

Aisha (may Allah Ta’ala be pleased with her) reports that (during the time of Nabi صلى الله عليه و سلم) a person divorced his wife thrice. She remarried and the second husband too divorced her. Nabi صلى الله عليه و سلم  was asked if it is permissible for her to return to her first husband. Nabi صلى الله عليه و سلم  replied: No! ...Until they have physical-relations.” Saheeh al-Bukhari (5/2014 Dar Ibn Katheer, al-Yamamah, Beirut)

 

2)

عن ابن عمر : قال سئل النبي صلى الله عليه وسلم عن الرجل يطلق امرأته ثلاثا فيتزوجها الرجل فيغلق الباب ويرخي الستر ثم يطلقها قبل أن يدخل بها قال لا تحل للأول حتى يجامعها الآخر – نسائي (ج6/ص460)

“Ibn Umar (may Allah Ta’ala be pleased with him) relates that Nabi صلى الله عليه و سلم was asked regarding a person who divorces his wife thrice after which another man marries her. After going in seclusion, he divorces her before this second husband can actually have intercourse; does she become permissible for the first husband to marry her? Nabi    صلى الله عليه و سلم replied, “No, until they have physical-relations.” Sunan al-Nasai (6/460 Dar al-Ma’rifah, Beirut)

The above two Ahadith clearly indicate that Nikah has terminated after three Talaqs.

3.     Verdicts of the Sahabah (Radhiallahu'anhum):

 

1)    Uthmaan (Radhiallahu'anhu)

وروى وكيع أيضا عن جعفر بن برقان عن معاوية بن أبي يحيى قال جاء رجل إلى عثمان بن عفان فقال طلقت امرأتي ألفا فقال بانت منك بثلاث - زاد المعاد (ج5/ص229)

Muawiya ibn Abi Yahya (may Allah Ta’ala have mercy on him) narrates that a person came to Uthman (may Allah Ta’ala be pleased with him) and said, “I have divorced my wife a thousand.” Uthman (may Allah Ta’ala be pleased with him) replied, “She is separated by three.” (Zad al-Ma’ad 5/229)

2)    Abdullah bin Masood (Radhiallahu'anhu)

حدثنا ابن فضيل ، عن مطرف ، عن الحكم ، عن ابن عباس ، وابن مسعود ، قالا : في رجل طلق امرأته ثلاثا قبل أن يدخل بها ، لا تحل له حتى تنكح زوجا غيره - مصنف ابن أبي شيبة (ج5/ص21)

Hakm (may Allah Ta’ala have mercy on him) says that Ibn Abbas (may Allah Ta’ala be pleased with him) and Ibn Masood (may Allah Ta’ala be pleased with him) said with regards to a person who divorces his wife thrice before having intercourse, “She is not permissible for the first husband until she marries another husband.”(Musannaf Ibn Abi Shaybah (5/21 Dar al-Salafiyyah)

4.     Ijmah (consensus):

 

1)

قال علماؤنا : واتفق أئمة الفتوى على لزوم إيقاع الطلاق الثلاث في كلمة واحدة ، وهو قول جمهور السلف - الجامع لأحكام القرآن(ج3/ص426)

“Our Scholars mention, “Those in the forefront of issuing religious verdicts all agree that three divorces are binding if said in one statement. This is the view of majority of our predecessors.” (Al-Jami li ahkam al-Quraan 3/129, Dar Alam al-kutub)

 

2)

فقال الشافعي ومالك وأبو حنيفة وأحمد وجماهير العلماء من السلف والخلف يقع الثلاث - شرح النووي على مسلم (ج10/ص70)

“Imam Shafi, Malik, Abu Hanifa, Ahmad (may Allah Ta’ala have mercy on them) and majority of the Scholars of the earlier and later periods say that three divorces take place.” (Sharh al-Nawawi ala Muslim (al-Minhaaj) 10/70, Dar ihya al-Turath al-Arabi)

From the above text, it is understood that there is consensus that three talaqs issue in one sitting will constitute three talaqs.
