Can I marry a chaste woman?


If someone commit sodomy (he just kissing another man with lust and did masturbation himself but he did not touch  another man's penis). Can he marry a chaste and pure woman? What does is meaning of sura An nur verses 3 and 4?


In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

1)     Every immoral act is a major sin and frowned upon in Shari’ah. A person that commits such acts must make sincere Tawbah. However, if a person committed such an act, it will be permissible for him to marry a pure and chaste woman.1 Verse number three of surah an-noor does not prohibit a person who committed an immoral act to marry a chaste woman.

2)    Hereunder is the third verse of surah-an-noor:

الزاني لا ينكح إلا زانية أو مشركة و الزانية لا ينكحها الا زان أو مشرك و حرم ذالك على المؤمنين(النور:3)

Translation: An adulterer marries only a adulteress or an idolatress and it is only an adulterer or an idolater who marries an adulteress. This(adultery and marriage to mushrikeen) is forbidden for the Mu’mineen (Noor: 3)

In this verse, Almighty Allah points out the common inclination of immoral people. Generally, an immoral man will be inclined to marry an immoral woman. However, the general inclination of such people to each other, does not mean an immoral man cannot marry a moral and chaste woman.2


و الذين يرمون المحصنات ثم لم يأتو بأربعة شهداء فاجلدوهم ثمانين جلدة و لا تقبلوا لهم شهادة أبد. و أولئك هم الفاسقون(النور: 4)

Translation: As for those who slander chaste women without presenting four witnesses, you should punished them eighty lashes and never accept the testimony ever again. These People are sinners. (Noor: 4)


This verse refers to the punishment of false accusation. If one made false accusation of zina against someone, and he/she is not able to substantiate the allegation with four witnesses, he/she will be punished with eighty lashes.3 4 It should be noted that this law will only apply in a Muslim country and under the jurisdiction of Qadhi (Muslim Judge).

ليس المراد في الآية أن الزاني لا ينكح قط إلا زانية إذ قد يتصور أن يتزوج غير زانية و لكن المعنى أن من تزوج بزانية فهو زان فكأنه قال لا ينكح الزانية إلا زان فقلب الكلام و ذالك أنه لا ينكح الزانية إلا و هو راض بزناها و إنما يرضى بذألك إذا كان هو أيضا يزني

الزنا يثبت بالبينة و الإقرار فالبينة أن تشهد أربعة من الشهود على رجل أو امرأة  بالزنا فسألهم الإمام عن الزنا ما هو؟ و كيف هو؟ و أين زنى ؟ و متى زنى؟ و بمن زنى؟ فإذا بينوا ذالك و قال رأيناه وطئها في فرجها كالميل في المكحلة و سأل القاضي عنهم فعدلوا في السر و العلانية حكم بشهادتهم

و أما حد القذف فسبب وجوبه القذف بالزنا لأنه نسبه إلى الزنا  و فيها إلحاق العار بالمقذوف فيجب الحد دفعا للعار عنه
