What is a kinaya divorce?


I Would like to know about Kinaya divorce.
When a husband says to her wife statements like go to your parents house, i dont Want to have anything with u anymore, we are finished, Its finished between us etc. Does it count as a divorce ?

I have read that the intention Should be there. By intention does it mean that the husband Should Think/ intention that with this statement i give divorce.
Im really confused. Kindly help me.

Sister in Islam,

If the husband makes the statements such as, go to your parent`s house, I don’t want to have anything with you  anymore, we are finished etc, with the deliberate /specific intention to issue a divorce, then that will constitute a talaq e baain. (An irrevocable divorce).[1]

وَقَالَ أَكْثَرُ الْمَشَايِخِ: إنَّ الْخِلَافَ فِي الْكُلِّ ثَابِتٌ؛ لِأَنَّ الْعَوَامَّ لَا يَهْتَدُونَ إلَى هَذَا وَلَا يُمَيِّزُونَ بَيْنَ إعْرَابٍ وَإِعْرَابٍ وَلَا خِلَافَ أَنَّهُ لَا يَقَعُ الطَّلَاقُ بِشَيْءٍ مِنْ أَلْفَاظِ الْكِنَايَةِ إلَّا بِالنِّيَّةِ فَإِنْ كَانَ قَدْ نَوَى الطَّلَاقَ يَقَعُ فِيمَا بَيْنَهُ وَبَيْنَ اللَّهِ تَعَالَى، وَإِنْ كَانَ لَمْ يَنْوِ لَا يَقَعُ فِيمَا بَيْنَهُ وَبَيْنَ اللَّهِ تَعَالَى، وَإِنْ ذَكَرَ شَيْئًا مِنْ ذَلِكَ ثُمَّ قَالَ: مَا أَرَدْتُ بِهِ الطَّلَاقَ يُدَيَّنُ فِيمَا بَيْنَهُ وَبَيْنَ اللَّهِ تَعَالَى؛ لِأَنَّ اللَّهَ تَعَالَى يَعْلَمُ سِرَّهُ وَنَجَوَاهُ.

وَهَلْ يُدَيَّنُ فِي الْقَضَاءِ؟ فَالْحَالُ لَا يَخْلُو إمَّا إنْ كَانَتْ حَالَةَ الرِّضَا وَابْتَدَأَ الزَّوْجُ بِالطَّلَاقِ وَإِمَّا إذَا كَانَتْ حَالَةَ مُذَاكَرَةِ الطَّلَاقِ وَسُؤَالِهِ، وَإِمَّا أَنْ كَانَتْ حَالَةَ الْغَضَبِ وَالْخُصُومَةِ فَإِنْ كَانَتْ حَالَةَ الرِّضَا وَابْتَدَأَ الزَّوْجُ بِالطَّلَاقِ يُدَيَّنُ فِي الْقَضَاءِ فِي جَمِيعِ الْأَلْفَاظِ لِمَا ذَكَرْنَا أَنَّ كُلَّ وَاحِدٍ مِنْ الْأَلْفَاظِ يَحْتَمِلُ الطَّلَاقَ وَغَيْرَهُ، وَالْحَالُ لَا يَدُلُّ عَلَى أَحَدِهِمَا فَيُسْأَلُ عَنْ نِيَّتِهِ وَيُصَدَّقُ فِي ذَلِكَ قَضَاءً

وَكِنَايَةُ الطَّلَاقِ (مَا) أَيْ لَفْظٌ (احْتَمَلَهُ) أَيْ الطَّلَاقُ (وَغَيْرُهُ) فَيَسْتَتِرُ الْمُرَادُ مِنْهُ فِي نَفْسِهِ فَإِنَّ الْبَائِنَ مَثَلًا يُرَادُ مِنْهُ الْمُنْفَصِلُ عَنْ وَصْلَةِ النِّكَاحِ، وَفِي الدَّلَالَةِ عَلَيْهِ خَفَاءٌ زَالَ بِقَرِينَةٍ (وَلَا يَقَعُ بِهَا) أَيْ وَلِهَذَا لَا يَقَعُ الطَّلَاقُ بِالْكِنَايَاتِ قَضَاءً (إلَّا بِنِيَّةٍ) أَيْ بِنِيَّةِ الزَّوْجِ، أَوْ الطَّلَاقِ مُضَافًا إلَى الْفَاعِلِ، أَوْ الْمَفْعُولِ (أَوْ دَلَالَةِ حَالٍ) ؛ لِأَنَّهَا غَيْرُ مَوْضُوعَةٍ لِلطَّلَاقِ بَلْ مَوْضُوعَةٌ لِمَا هُوَ أَعَمُّ مِنْهُ وَالْمُرَادُ بِدَلَالَةِ الْحَالِ الْحَالَةُ الظَّاهِرَةُ الْمُفِيدَةُ لِمَقْصُودِهِ وَفِيهِ إشَارَةٌ إلَى أَنَّ الْكِنَايَاتِ غَيْرُ مُؤَثِّرَةٍ بِدُونِ النِّيَّةِ وَدَلَالَةِ الْحَالِ.
