Salamalikum wa rahmatuallh hi wa baratahu, I have only one child, a daughter. I have read that, a sole daughter can’t inherit the entire estate after the death of her parents. Part of it must go to my brother’s son, ie my nephew. My question is that how can I make sure, during my lifetime, that all of my estate, or at least, most of it goes to my daughter. I have been told that I can gift it to her during my life time. My nephew, with whom I enjoy very cordial relations, has no issues in surrendering his claim and has given so in writing. As concerned parents, we want to insure financial security for our daughter, but at the same time we do not want to transgress the rules set by Allah subhanutaala. Hence we are looking for a solution which achieves both these objectives. Thank you and jazakallahkhaira !

As-salāmu ‘alaykum wa-rahmatullāhi

If you are survived by only one daughter and your brother’s son, then your daughter will receive half your estate and the balance will be inherited by your brother’s son. You may gift your daughter your wealth in your lifetime to secure her. However, your intention should not be to deprive your nephew of inheritance.[1]

ولو وهب رجل شيئا لأولاده في الصحة وأراد تفضيل البعض على البعض في ذلك لا رواية لهذا في الأصل عن أصحابنا ، وروي عن أبي حنيفة رحمه الله تعالى أنه لا بأس به إذا كان التفضيل لزيادة فضل له في الدين ، وإن كانا سواء يكره وروى المعلى عن أبي يوسف رحمه الله تعالى أنه لا بأس به إذا لم يقصد به الإضرار ، وإن قصد به الإضرار سوى بينهم يعطي الابنة مثل ما يعطي للابن وعليه الفتوى هكذا في فتاوى قاضي خان وهو المختار ، كذا في الظهيرية .


عمدة القاري شرح صحيح البخاري (13/ 145) 

 فإن قلت: في حديث الباب الأمر بالرجوع صريحا حيث قال: (فارجعه) قلت: ليس الأمر على الإيجاب، وإنما هو من باب الفضل والإحسان، ألا ترى إلى حديث أنس رواه البزار في (مسنده) عنه: (أن رجلا كان عند رسول الله صلى الله عليه وسلم، فجاء ابن له فقبله وأجلسه على فخذه، وجاءته بنية له فأجلسها بين يديه، فقال رسول الله صلى الله عليه وسلم: (ألا سويت بينهما؟) انتهى. وليس هذا من باب الوجوب، وإنما هو من باب الإنصاف والإحسان. 


الدر المختار وحاشية ابن عابدين (رد المحتار) (5/ 696) 

وفي الخانية لا بأس بتفضيل بعض الأولاد في المحبة لأنها عمل القلب، وكذا في العطايا إن لم يقصد به الإضرار، وإن قصده فسوى بينهم يعطي البنت كالابن عند الثاني وعليه الفتوى ولو وهب في صحته كل المال للولد جاز وأثم
