Title: Iddat of a Widow

Question

Assalamoalaikum,

Kisi aurat ke shohar ka inteqal ho gaya hai. shuru se un dono miya biwi ki azdwaji zindagi khushgawar nahi rahi hai. biwi shuru se nokri karti hai. shohar ke inteqal se lagbhag 2 sal pahle se shohar ne kharcha dena band kar diya tha. biwi abhi ek madarsa chalati hai jis mai uski mehnat se 40-50 bacche talim hasil kar rahen hain. madarsa ghar se door hai. Unke madarse na jane se Madarse mai dusri teachers  laparwahi barat ti hain. Wo agar madarse na jay to madarsa band hone ke imkan hain. Us aurat ke teen bacche hai do ladke aik ladki teeno ki shadi ho chuki hai. dono ladko ki mashi halat thik nahi hai.

sawal yeh hai ki woh aurat agar madarse ke baccho ke nuqsan ki wajah se madarse ja sakti hai ya nahi.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Ayyam-e-iddat me agar kharch ka intezaam ho, to mehaz madrasa ke band hone ke khadshe se ghar se bahar nikalna ja`iz nahi.[1] [2] [3] [4] [5]

Mutadda[iddat guzaarne wali khatoon] madrase ki muallimaat ko is amr ka papand bana sakti hain ke dauran-e-iddat woh hafta-warana[weekly] taleemi report khud laker ya email wagera se pesh karti rahein. Is se madrase ka taleemi nizam bhi durust rahega aur muttada to ghar se nikalna bhi nahi padega.

[4] Ahsan-Ulfatawa [431/5] متعدہ موت کے پاس اگر نفقہ نہ ہو تو کسب معاش کی حاجت سے گھر سے نکل سکتی ہے.المستفاد:لان نفقتها عليها فتحتاج للخروج حتى لوكان عندها كفايتها صارت كالمطلقة فلا يحل لها الخروج.

[5] Aap ke masail aur unka hal [399/5] اگر خرچ کا انتظام ہو،تو ملازمت بھی جائز نہیں.
